Things you need to know upfront

You need to be aware of the following before you start working as a free worker:

Click the blue 'Next' button when you have read the text.

  1. No boss
As a free worker, you are a freelancer (self-employed person without staff, or a natural person without a Chamber of Commerce registration). So you don't have an employer who tells you when to work; you are a collaborative partner.

Things you need to know upfront

You need to be aware of the following before you start working as a free worker:

  1. Compensation and social security
When you work, you receive compensation: this is not a salary or wage. If the task stops earlier than scheduled, you will only be paid for the hours worked. The compensation is always higher than the hourly minimum wage. In the event of illness, you can receive financial support from our support foundation. The point of departure in that case is the social security package associated with your task. For odd jobs and a little extra income, you usually don't receive any support, but as your income becomes more structural, your social security also increases to the point where you can eventually get up to 27 months of assistance in the event of sickness and disability.

Things you need to know upfront

You need to be aware of the following before you start working as a free worker:

  1. Payment

You are paid weekly, unless you agree something else. The amount paid is gross: so you still have to pay taxes on it! How much tax you have to pay depends on your total annual income. How much you need to set aside to pay income tax depends on your total annual income:

    • € 0 - € 6.500: Set aside 7%;

    • € 6.500 - € 20.000: Set aside 10%;

    • € 20.000 - € 50.000: 2 Set aside 25%.

Things you need to know upfront

You need to be aware of the following before you start working as a free worker:

  1. Taxation

Work Standby reports the compensation paid to you to the Dutch Tax and Customs Administration (Belastingdienst) each year. You also receive this annual statement yourself and can use it for your income tax. You do not have to file a VAT return if you work as a natural person. If you are a self-employed person without staff (Zelfstandige Zonder Personeel) and work as a free worker, you should continue to file a VAT return and VAT will also be included in your compensation.

How to proceed

You need to do the following to start working as a free worker:

  1. Look for a match with task offers
After you register, your contact person will create an account for you in our app. Most free workers register because they have already been approached by an intermediary, or a work provider, or have been encouraged by friends to start working as a free worker. So, if you are still looking for work, it may take some time before a match can be made. Sometimes your contact person will call you to ask if you want to start working straightaway.

How to proceed

You need to do the following to start working as a free worker:

  1. Report your hours

After you have done the work, your work provider must approve the hours worked. If the hours you worked differ from the scheduled task time, those are the hours that count. All the hours worked notified to us by Monday 11.59 pm will be paid on Wednesday.

How to proceed

You need to do the following to start working as a free worker:

  1. Cancellation
When you commit to a task offer, you are expected to do the work. If you would rather not work for any reason, you can try to swap the task offer with a fellow free worker in your skills pool.

What if no one else is willing to accept the work offer? Then you are still expected to do the work. If you have a serious problem, you should contact the skills pool manager and your work provider.

If you are ill, you should report this to your skills pool manager and your work provider as soon as possible. Whether you get paid during illness depends on the social security package associated with the task.

How to proceed

You need to do the following to start working as a free worker:

  1. Flexibility subject to mutual agreement
When you commit to a task offer, you are expected to do the work. You can agree different hours in consultation with the work provider. The work provider may also ask you if you want to work longer; it's up to you to decide if you want to. You always get paid for the extra hours. If the task ends earlier than scheduled, the work provider may tell you to leave. You will then be paid only for the hours worked.

Sign authorisation

To make it possible for you to work as a free worker, we must enter into an agreement with your company, i.e. the work provider, on your behalf. We have to do this for each free worker and also for each new task offer, which is why we ask you to authorise us to do so. The statement of consent setting out what you authorise us to do is included below. Free Worker appears everywhere instead of your name because you authorise us to link you, as a free worker, with a work provider.

Please read this and then sign the authorisation on page 3.

Summary of the three-party agreement for offering and accepting work through mediation number 20250226.01

  1. Work Provider, through mediation by WSB, offers work activities which can be accepted by Free Worker and subsequently performed by Free Worker.

  2. Through this agreement, the parties agree among themselves that they explicitly do not wish to enter into an employment contract within the meaning of Section 610 and following of Book 7 of the Dutch Civil Code, and Free Worker understands that the protective provisions of labour law do not apply to this agreement.

  3. Work Provider and Free Worker expressly wish to avoid the applicability of the ‘notional employment relationship contracted via an intermediary’ (fictieve dienstbetrekking van tussenkomst).

  4. Free Worker accepts the task offer and thereby accepts full responsibility for proper performance of the agreed work activities.

  5. Free Worker performs the work activities associated with the task offer independently, according to the rules of Free Working.

  6. In this agreement, Free Worker does not agree to a legal obligation to perform work activities, but instead states his/her willingness to perform the work activities. The obligation to come to work arises only after a task offer has been accepted.

  7. Work Provider and Free Worker may both interrupt, suspend or permanently stop the work activities of Free Worker at any time.

  8. Free Worker, if not able to perform the work for any reason, may arrange for the work activities to be performed by another free worker from the same skills pool.

  9. Work Provider may only refuse a substitute if the substitute does not meet objective criteria necessary to properly perform the work activities.

  10. WSB owes compensation to Free Worker for the performance of the work activities. Work Provider expressly does not pay Free Worker for the work activities performed by Free Worker. Within the Work Standby consortium, in which WSB collaborates with other parties to implement Free Working, HVW Betaal BV is responsible for all financial matters, such as invoicing and disbursement.

  11. In addition to the agreed compensation for the work activities performed, travel expenses, accommodation expenses, the cost of any materials, other expenses and travel time may be part of the compensation paid to the free worker. It can also be agreed at the time of committing to the task offer that these items will be charged separately.

  12. Free Worker expressly does not receive compensation in respect of hours during which Free Worker did not perform work activities on behalf of Work Provider such as, for example, during illness and leave and after the work activities have ended. In the event of incapacity for work or after termination of the work activities, Free Worker has no claim to any payment from Work Provider and/or WSB and/or benefit agency. Outside these parties, however, provisions are available that match the job profile of the free worker.

  13. In Free Working, the actual hours worked are paid and not the scheduled hours. At the time of committing to the task offer, allowances or bonuses may have been agreed for additional hours worked, specific achievements or additional responsibilities associated with the accepted task.

  14. Free Worker shall never disclose any confidential information of which he/she becomes aware in the course of performing work activities for Work Provider.

  15. WSB is not involved, but can assist in the process of offering and accepting task offers (or offers of work) and the further arrangements made with respect to the associated work activities, as formulated, if desired, in Appendix 2 of the three-party agreement.

  16. WSB legally supports both parties in advance and if unexpected legal or tax issues arise with respect to the work activities performed by free workers.

  17. The Agreement is entered into for the duration of Free Worker's work activities and may contain a specific start and end date or continue indefinitely until the work activities finally come to an end.

  18. The parties are aware of the General Terms and Conditions and the three-party agreement for offering and accepting work through mediation.

I authorise Indat Werk Standby B.V. (trading under the name of Werk Standby, abbreviated as WSB ), registered with the Chamber of Commerce under number 63441446, registered address PO Box 14176, 3508 SG Utrecht, duly represented in this matter by P.B.J. van der Eijk, exercising the powers of the position of director, hereinafter referred to as “WSB”,

to sign on behalf of Free Worker the letter of agreement regarding the three-party agreements for contracting work through mediation, number 20250226.1, where the sequence number can run from 01 to 99.

In the case of misunderstandings and conflicts, WSB is responsible for coordinating submission to the parties in question of any statement of agreement involved in the matter. Costs may be charged if statements of agreement are requested without a concrete legal cause, as the associated work is not included in the agreed rates and compensation. WSB is solely authorised to sign statements of agreement as described above on behalf of Free Worker. Free Worker may revoke the authorisation to sign the aforementioned statements of agreement at any time. Any agreements for performing work made before the revocation, but scheduled to take place after the revocation, remain legally valid. Revocation of this authorisation will always be construed by Work Standby as an instruction to deregister you as a Free Worker.
